SUPPLEMENT TO GOVERNING DOCUMENTS FOR WOOD MEADOW COMMUNITY IMPROVEMENT ASSOCIATION DOCUMENTS GOVERNING THE FOLLOWING SUBDIVISIONS: WOOD MEADOW, SECTION TWO FILED OF RECORD IN COMPLIANCE WITH SECTION 202.006 OF THE TEXAS PROPERTY CODE AS PART OF THE DEDICATORY INSTRUMENT GOVERNING THE ABOVE-DESCRIBED SUBDIVISION RESOLUTION REGARDING COMMUNITY SERVICE CHARGES WOOD MEADOW COMMUNITY IMPROVEMENT ASSOCIATION A TEXAS NON-PROFIT CORPORATION WHEREAS, the By-Laws governing Wood Meadow Community Improvement Association, Inc., ("the Association"), as well as Chapter 204 of the Texas Property Code and the Texas Non-Profit Corporation Act, authorize the Association to exercise all powers reasonable and necessary for the governance and operation of the Association; and
WHEREAS, the Texas Property Code further authorizes the Association, acting through its board of directors, to adopt and amend budgets for revenues, expenditures, and reserves and collect regular assessments or special assessments for common expenses from property owners; and
WHEREAS, the Texas Property Code further authorizes the Association, acting through its board of directors, to impose and receive payments, fees, or charges for the use, rental, or operation of the common area and for services provided to property owners;
WHEREAS, the Association's Board of Directors has determined that the adoption and/or modification of certain policies, procedures, rules and/or guidelines are necessary and desirable for the fair, efficient, consistent, uniform and cost effective management of the Association, and that such action would serve the best interest of the Associaiton and its members, particularly in light of increasing utility costs which are paid by the Association and its members, particularly in light of increasing utility costs which are paid by the Association on a regular and ongoing basis; and
WHEREAS, the Association's Board of Directors has also determined that it is in the Association's best interest, and in the best interest of the Wood Meadow community, to adopt, implement and impose a Community Service Charge relating to utility costs and expenses relating to electricity and other utilities provided by the Association for the benefit of the Wood Meadow community. Such charge shall be in the of Thirty and No/100 Dollars ($30.00) per year, and which shall be applicable to and otherwise levied against each and every Lot within the Wood Meadow subdivision. The first such Community Server Charge shall be due and payable on January 1, 2008, and shall be assessed/charger on the 1st day of January of each successive calendar year thereafter, until such charge is either decreased or increased by the Board of Directors.
NOW, THEREFORE, BE IT RESOLVED that the following policies and/or procedures regarding the imposition of a community service charge are hereby adopted on behalf of the Association:
1. In accordance with Chapter 204 of the Texas Property Code, each and every Lot withing the Wood Meadow subdivision shall be assess a utility charge (Community Service Charge) in the of Thirty and No/100 Dollars ($30.00), the first of which shall be due and payable on January 1, 2008. There shall be a similar charge levied against each Lot for each successive year thereafter, which charge may be decreased, increased or discontinued at the discretion of the Board of Directors, provided each Lot shall be charged the same amount. Payment of such community service charge shall be mandatory in nature, with each respective Lot owner being personally liable for payment of same.
